Welcome to Motif Fine Portraits. By accessing or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Definitions

  • "Company" refers to Motif Fine Portraits, its affiliates, and subsidiaries.

  • "Client" refers to any individual or entity using the services of the Company.

  • "Services" refer to photography, portrait creation, and any related offerings provided by the Company.

2. Acceptance of Terms

By using our Services, you affirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years old.

  • Provide accurate and complete information when requested.

  • Comply with applicable laws and regulations.

4. Services Provided

The Company specializes in bespoke portrait photography and related artistic services. Details of Services, pricing, and packages are outlined on our website or provided upon consultation.

5. Booking and Payments

  • Deposit: A non-refundable deposit is required to secure a booking.

  • Payment Terms: Full payment must be made prior to the final delivery of any artwork.

  • Cancellation Policy: Cancellations must be made 14 days in advance. Otherwise, the refundable deposit will become non-refundable. Any cancellations or rescheduling during this time are subject to this policy.

  • Rescheduling: Rescheduling is permitted prior to 2 weeks before the session with no fee incurred. Any rescheduling after this time will result in the loss of the original deposit, and a new deposit will be required.

6. Intellectual Property

All photographs and artworks created by Motif Fine Portraits remain the intellectual property of the Company unless explicitly transferred in writing. Clients are granted a limited license for personal use of delivered artworks.

7. Client Responsibilities

  • Clients must arrive on time for appointments. Late arrivals may result in reduced session time or rescheduling fees.

  • Clients must provide all feedback on proofs on the day of their order session. These requests will be considered final.

8. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, or consequential damages arising from the use of our Services.

9. Dispute Resolution

Any disputes will be resolved in accordance with Ontario law. If a resolution cannot be reached amicably, disputes will be settled through arbitration in Ontario.

10. Privacy and Data Collection

The Company collects and uses personal data in accordance with our Privacy Policy. By using our Services, you consent to the collection and use of data as outlined in our Privacy Policy.

11. Modification of Terms

The Company reserves the right to modify these Terms of Service at any time. Clients will be notified of changes via email or website update. Continued use of the Services constitutes acceptance of the revised terms.

13. SMS Communication and Consent

Consent to Receive SMS Messages:
By providing your phone number during booking or inquiries, you consent to receive recurring SMS communications from Motif Fine Portraits. These messages include, but are not limited to:

  • Appointment confirmations and reminders.

  • Updates on artwork proofs or project status.

  • Promotional offers, if opted in.

Opt-In Process:
Consent to receive SMS messages is obtained through the following methods:

  1. Website Form: When booking or requesting information on our website, users must explicitly check a box agreeing to receive SMS messages.

  2. Verbal or Written Consent: During consultations or bookings, clients may verbally confirm or sign agreement to SMS communication.

  3. Text Opt-In: Users can text START to 647-559-3513 and-or 647-693-9401 to receive messages.

Opt-Out Process:
You may opt out of receiving SMS messages at any time by replying STOP to any message. Upon opting out, you will no longer receive text messages unless you explicitly opt back in.

Message Frequency and Disclaimer:
You will receive messages related to your services and reminders as needed, typically no more than 2-5 messages per month. Message and data rates may apply.
